Important role distinction: Boomers Greens controls information it collects for its website, sales, licensing, and support. A Swingistry Golf subscriber generally decides what participant registration data and guest photos to collect at its events and is responsible for the event-facing notice and consent process.

Scope

This Privacy Policy explains how Boomers Greens LLC ("Boomers Greens," "we," "us," or "our") collects, uses, discloses, and retains personal information in connection with boomersgreens.com and related website forms; Swingistry Golf and its licensing and support; Lemon Squeezy transactions and subscription administration; event registration kiosks and guest photo upload features to the extent information is received by Boomers Greens; and communications with us.

This policy does not govern a customer's independent business practices, its event operations, or third-party services that publish their own privacy policies. If you use Swingistry Golf at an event run by another business, that event operator's privacy notice may apply in addition to this policy.

Our Roles and the Event Operator's Role

Boomers Greens determines the purposes and means of processing for information collected directly through its website, sales and licensing records, business communications, product security, and support. For participant registration records, scores, guest photos, and other event information configured and collected by a Swingistry Golf subscriber, the subscriber generally determines why and how the information is collected and displayed. Boomers Greens processes such information only when it is transmitted to a system we operate, included in a support request, or otherwise made available to us.

Swingistry Golf is designed for use on customer-managed Windows computers and event networks. Depending on configuration, much event information may remain on systems controlled by the subscriber and may never be received by Boomers Greens. Subscribers are responsible for their own privacy notices, lawful basis or consent, field selection, display choices, user access, exports, backups, retention, and deletion.

Information We May Collect

Website and Form Information

When someone visits boomersgreens.com or submits a form, we may collect name, email address, phone number, business or organization, event details, requested services, message content, referral information, communication preferences, and other information the person chooses to provide. Website technology may also collect IP address, browser and device type, operating system, pages viewed, referring page, approximate location derived from IP, date and time, cookie or similar identifiers, and interaction or diagnostic data.

Purchase, Subscription, and Transaction Information

Lemon Squeezy acts as merchant of record and collects checkout, payment, tax, billing, and transaction information under its own terms and privacy policy. We may receive order number, customer name and email, business or billing details, country or region, product and variant, price, discount, tax status, invoice or receipt data, subscription status, renewal and cancellation dates, refund or dispute status, and related platform identifiers. Boomers Greens normally does not receive the full payment-card number used at checkout.

Licensing, Device, and Technical Information

To issue, activate, validate, deactivate, secure, and support a Swingistry Golf license, we and Lemon Squeezy may process license-key status, product and variant, subscription status, activation limit and usage, license or activation-instance identifiers, computer or installation name or identifier, IP or network information, application version, operating system, activation and validation results, timestamps, error messages, security signals, and diagnostic information. We do not need a guest's registration data or photos to validate a subscription license.

Kiosk Registration and Event Information

A subscriber may configure Swingistry Golf to collect participant or guest information such as name, email address, phone number, organization, team or division, event selection, registration status, consent or acknowledgement responses, scores, attempts, standings, check-in information, notes, and other fields selected by the subscriber. The exact fields vary by event and subscriber configuration. If this information remains on subscriber-controlled systems, the subscriber controls it. If it is sent to Boomers Greens for support or another requested service, we use it as described in this policy.

Guest Photos and Uploaded Content

Guest photo features may process images, captions or messages, uploader-supplied contact or registration information, event association, timestamps, file and device metadata, and moderation or display status. Photos may show faces, bystanders, minors, venue details, or other personal information. The event operator determines whether photos are accepted and displayed and must provide the required notice and obtain appropriate permissions or parental consent. Do not upload a photo you do not have the right to submit and display.

Support and Business Communications

When someone contacts us, we may collect the communication, contact details, purchase and license information, screenshots, logs, attachments, event details, troubleshooting steps, device and network details, and records of our response. Please remove unrelated personal information before sending files and do not send full payment-card numbers or unnecessary sensitive information.

How We Use Information

·       provide, license, activate, validate, maintain, secure, troubleshoot, update, and support Swingistry Golf;

·       respond to website forms, sales inquiries, support requests, cancellation or refund inquiries, and other communications;

·       administer purchases, subscriptions, license entitlements, receipts, refunds, disputes, taxes, and payment recovery with Lemon Squeezy;

·       operate website features and understand usage, performance, reliability, and demand;

·       detect and prevent fraud, license sharing, activation abuse, security incidents, unlawful activity, and violations of customer terms;

·       maintain business, accounting, tax, compliance, support, and legal records;

·       enforce agreements, protect rights and safety, and establish, exercise, or defend legal claims;

·       communicate service, security, product, policy, and subscription information; and

·       improve products and operations using aggregated, de-identified, or otherwise lawfully processed information.

Where applicable law requires a legal basis, processing may be based on performance of a contract, legitimate interests, compliance with legal obligations, consent, or another basis available under law. Consent may be withdrawn where consent is the basis, but withdrawal does not affect prior lawful processing.

How We Disclose Information

We may disclose personal information to the following categories of recipients for the purposes described above:

·       Lemon Squeezy for merchant-of-record checkout, payments, taxes, subscriptions, licensing, customer portal, fraud management, refunds, and disputes;

·       service providers supporting website hosting and forms, email, file storage, analytics, security, software delivery, diagnostics, communications, and support;

·       professional advisers such as attorneys, accountants, insurers, auditors, and consultants where reasonably necessary;

·       government authorities, courts, law enforcement, regulators, or other parties when required by law or reasonably necessary to protect rights, safety, and security;

·       a buyer, lender, investor, successor, or adviser in connection with a proposed or completed financing, merger, reorganization, sale, or transfer of all or part of the business, subject to appropriate confidentiality and legal requirements; and

·       other parties at the direction of the person or subscriber that controls the information, or with consent.

Boomers Greens does not sell personal information for money. Some privacy laws may define certain analytics or advertising disclosures as a "sale" or "sharing" even without payment. If we use technology subject to those definitions, we will provide the notice and choices required by applicable law.

Event Displays and Subscriber-Directed Disclosure

Swingistry Golf is designed to help subscribers display registration status, participant names, scores, standings, sponsor content, guest photos, winners, and other event information to operators, participants, or spectators. Those displays are directed and configured by the subscriber. Participants should ask the event operator how information will be displayed, shared, exported, or retained. Boomers Greens is not responsible for a subscriber's independent disclosure outside the systems and instructions Boomers Greens controls.

Cookies and Similar Technologies

Our website and service providers may use cookies, pixels, local storage, logs, and similar technologies to operate forms and pages, remember choices, maintain security, diagnose performance, measure site use, and support analytics. Available controls may include a site notice or preference tool, browser settings, and device settings. Blocking some technologies may affect website functions. Third-party sites, including Lemon Squeezy, control their own cookies and choices.

Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this policy, including providing the Software and support; maintaining subscription, license, security, accounting, tax, transaction, consent, and dispute records; complying with law; and establishing or defending legal claims. The period depends on the type of information, its sensitivity, the relationship, operational need, legal requirements, and whether a dispute or security issue exists.

Information on subscriber-controlled computers is retained or deleted by the subscriber. Information deleted from active systems may persist for a limited time in backups, security logs, archives, or records retained for legal purposes. We may retain aggregated or de-identified information where it no longer identifies a person.

Security

We use reasonable administrative, technical, and organizational measures appropriate to the nature of the information and the size and operation of the business. No method of transmission, storage, software, or security control is completely secure, and we cannot guarantee absolute security. Subscribers are responsible for securing their computers, local networks, exports, backups, email accounts, portal links, license keys, and user access. We will respond to security incidents and provide notices as required by applicable law.

Privacy Choices and Requests

Depending on location and applicable law, a person may have rights to request access, correction, deletion, restriction, objection, portability, or information about disclosures; to withdraw consent; or to appeal a decision. These rights may be limited by identity verification, legal exceptions, security, the rights of others, and record-retention obligations.

Requests concerning information held by Boomers Greens may be sent to support@boomersgreens.com. We may ask for information reasonably necessary to verify identity and authority. If the request concerns registration data or a photo collected at an event run by a Swingistry Golf subscriber, contact that event operator first because it may control the information and may be the only party with access to it. We will assist a subscriber with a request when required and reasonably possible.

Marketing emails may be declined using the unsubscribe method in the message or by contacting us. Transactional, licensing, security, legal, and support communications may still be sent when necessary for the relationship.

Children and Minors

Boomers Greens' direct software sales and business support services are not directed to children under 13. Event operators may host events attended by minors. A subscriber must not use Swingistry Golf to collect a child's personal information or display a minor's photo contrary to law and is responsible for any required parent or guardian notice and consent. If Boomers Greens learns that personal information was provided to it in violation of applicable children's privacy law, it may delete or restrict the information and contact the subscriber.

International Processing

Boomers Greens is based in Ohio, United States. Information may be processed in the United States and other locations where service providers operate. Privacy laws in those places may differ from those in a person's home jurisdiction. Where required, we and our providers will use an approved transfer mechanism or other lawful basis.

Third-Party Services and Links

Lemon Squeezy, website hosts, payment methods, browsers, email providers, social networks, and linked websites have separate privacy practices. Review their policies before providing information. This policy does not control information collected independently by those third parties.

Changes to This Policy

We may update this Privacy Policy to reflect product, vendor, legal, or operational changes. The current version should display an updated or effective date.
